When Does a Drug Case Become a Federal Matter?

State and federal prosecutors often have overlapping jurisdiction in drug cases, but certain facts push a case into federal court. The most common trigger is which agency conducted the investigation. When the DEA or FBI leads the investigation and makes the arrest, federal charges often follow. Arrests that stem from informants already embedded in a federal investigation follow the same path.

Drug activity that crosses state lines falls under federal jurisdiction based on interstate commerce law. When prosecutors allege that the activity is connected to a larger criminal enterprise, they’re more likely to bring federal charges and, in some cases, RICO counts. Federal charges, as a rule, carry harsher penalties than their state equivalents.

Federal Drug Sentencing: Mandatory Minimums & the Sentencing Guidelines

Federal drug convictions carry mandatory minimum sentences that judges can’t go below absent specific statutory exceptions, regardless of individual circumstances. The severity of those minimums depends in part on the controlled substance involved. Schedule I substances, which the DEA defines as having no currently accepted medical use and a high potential for abuse, and Schedule II substances, which carry an equally high abuse potential but retain a recognized medical use subject to strict controls, carry the strictest penalties. Heroin, fentanyl, cocaine, and methamphetamine are common examples.

Federal courts use the United States Sentencing Guidelines to calculate an advisory sentencing range based on offense severity and the defendant’s criminal history. Unlike state sentences, federal drug sentences are served without the possibility of parole. Sentencing hearings are consequential proceedings where guideline objections, written sentencing memoranda, and arguments about mitigating factors can all affect where a judge sentences within the range and whether any departure from that range is warranted.
